Are the busiest mediator necessarily the most effective?

The theory is that the market decides who gets the work or not. In practice, I don’t think that really happens, because there are a lot of good mediators who are not very busy. A lot of it is who you know and where your contacts are. What’s the network that you can draw on to give you work and so on.


That’s one of the reasons why there are a lot of barristers who’ve become mediators because they are in an ideal position to have the stature with the law firms. Those are the solicitors who get out and work. I think there are quite a few busy mediators who are not necessarily, what I’d say, demonstrating real qualities of mastery that I’d like to see.
